1. General provisions

1.1. These Terms of Use (the «Terms») govern the relationship between Traffic Limited Liability Company (OOO «Trafik») (the «Administration», the «Operator») and any person using the k-publishing.ru website (the «Website»; such person is referred to below as the «User»).

1.3. These Terms constitute a public offer within the meaning of article 437 of the Civil Code of the Russian Federation. The User is deemed to accept the offer by starting to use the Website in any form, including viewing its pages.

1.4. A User who does not agree with these Terms in whole or in part must immediately stop using the Website.

1.5. Use of the Website is additionally governed by the Personal Data Processing and Privacy Policy and by the Cookie Policy. Those documents form an integral part of these Terms.

2. Description of the Website

2.1. k-publishing.ru is the corporate website of the Kinoafisha internet publishing house. The Website contains information about the Operator, its media projects, lines of business, terms for placing advertising and for cooperation, and details of current job openings.

2.2. Access to the materials of the Website is provided to the User free of charge.

2.3. The Website has no User registration, personal accounts, comments or other forms of user-generated content. The contact forms are intended solely for sending enquiries to the Operator.

2.4. The Website is not a mass medium and does not sell goods or services by distance selling. Information about services published on the Website is provided for information purposes and does not constitute a public offer within the meaning of article 437 of the Civil Code of the Russian Federation unless expressly stated otherwise.

3. Age restriction

3.1. The Website as an information product carries the age rating «16+».

3.2. Persons under 16 may use the Website with the consent and under the supervision of a parent or another legal representative.

4. Intellectual property

4.1. All materials of the Website — texts, design, design elements, graphics, icons, images, program code and the structure of the Website — are the intellectual property of the Operator or are used by it on lawful grounds, and are protected by the legislation of the Russian Federation.

4.2. Trademarks, commercial designations and project names mentioned on the Website belong to the Operator or to the respective rights holders.

4.3. Use of the materials of the Website without the Operator’s written permission is not allowed, except for quotation to the extent justified by the purpose of the quotation, with mandatory attribution of the source and an active hyperlink to the Website that is open to indexing.

4.4. Copying the materials of the Website for commercial purposes, reworking, distributing and communicating them to the public without the Operator’s permission is prohibited.

4.5. If the User believes that material published on the Website infringes their exclusive rights, they may send a reasoned enquiry to info@k-publishing.ru identifying the disputed material, substantiating their rights and providing contact details. The Operator reviews such enquiries within 30 (thirty) calendar days.

5. Content of materials and disclaimers

5.1. The Operator makes reasonable efforts to keep the information on the Website up to date, but does not guarantee that it is complete and free of errors at any given time.

5.2. Figures on audience, reach and how long projects have been running are given for reference, reflect the Operator’s own data and may change. Exact figures for a specific project are provided on request.

5.3. The Website contains links to external resources, including the Operator’s own projects and third-party websites. The Operator is not responsible for the content of external resources, for their availability, or for the consequences of the User following such links.

5.4. The materials of the Website do not constitute individual legal, financial, tax or investment advice.

6. Enquiries through the contact forms

6.1. The User may send the Operator an enquiry through the contact forms published on the Website or to the e-mail addresses given on the Website.

6.2. By submitting an enquiry the User confirms that the information they have provided is accurate and consents to the processing of personal data to the extent and on the terms set out in the Personal Data Processing and Privacy Policy.

6.3. The Operator reviews enquiries within a reasonable time and does not guarantee a reply to enquiries of a promotional nature, to enquiries unrelated to the Operator’s activities, or to enquiries containing insults or inaccurate information.

6.4. Sending an enquiry does not oblige the Operator to enter into a contract, to acquire the User’s project, to publish advertising material or to invite a candidate to an interview.

6.5. Users should not send through the contact forms any information constituting a secret protected by law, or special categories of personal data.

7. Prohibited actions

7.1. The User is prohibited from:

  • taking actions that disrupt the operation of the Website, including distributed attacks, automated bulk requests and attempts to gain unauthorised access;
  • using automated tools to send enquiries in bulk through the Website’s forms;
  • sending promotional mailings, malicious links and files through the Website’s forms;
  • copying the structure, design and program code of the Website in order to create similar resources;
  • impersonating a representative of the Operator or any other person;
  • taking any other action that breaches the legislation of the Russian Federation.

7.2. If breaches are detected, the Operator may restrict the User’s access to the Website by technical means without prior notice.

8. Liability

8.1. The Website is provided on an «as is» basis. The Operator does not guarantee uninterrupted and error-free operation of the Website or its compatibility with any software or hardware of the User.

8.2. The Operator is not liable for losses incurred by the User in connection with the use of, or the inability to use, the Website, except in the cases expressly provided for by the legislation of the Russian Federation.

8.3. The Operator is not liable for the acts of communication providers or for failures of networks and of the User’s equipment.

8.4. The User is solely responsible for the accuracy of the information they send through the contact forms.

9. Amendments to the Terms

9.1. The Operator may amend these Terms unilaterally. The current version is always available on the Website, stating the date of the last revision.

9.2. Continued use of the Website after the amendments take effect means that the User agrees to the new version of the Terms.

10. Governing law and dispute resolution

10.1. These Terms and the relationship between the parties are governed by the law of the Russian Federation.

10.2. The parties shall seek to settle disputes through a pre-action claim procedure. The time limit for replying to a claim is 30 (thirty) calendar days from the date it is received.

10.3. If no agreement is reached, the dispute shall be heard by a court at the Operator’s location in accordance with the legislation of the Russian Federation.
